Who can use Geldfish

• You must be at least 18 years old and able to enter into a binding contract.
• Geldfish is intended for people in the United States and supports US financial institutions.
• Geldfish is currently in private beta. Access is by invitation, and we may limit or change who can sign up.

What Geldfish is, and isn’t

Geldfish projects your checking, savings, investments and debt on a calendar using schedules you set up and, if you choose, data from your financial institutions.

• Projections are estimates. They depend on the information you and your institutions provide and can be incomplete, delayed or wrong.
• Not advice. Geldfish is a planning tool. It is not financial, investment, tax, legal or credit advice, and we are not a bank, broker or adviser.
• Read-only. Geldfish cannot move money, make payments or trade on your behalf.

Your account

• Give accurate information and keep it up to date.
• Keep your password and authenticator secure. Two-factor sign-in is required on every account. You’re responsible for activity under your account.
• Tell us right away at team@geldfish.com if you think someone else has accessed your account.

Connecting your financial accounts

Geldfish uses Plaid Inc. (“Plaid”) to gather your data from financial institutions. By using our service, you grant Otterlytics LLC and Plaid the right, power, and authority to act on your behalf to access and transmit your personal and financial information from your relevant financial institution. You agree to your personal and financial information being transferred, stored, and processed by Plaid in accordance with the Plaid End User Privacy Policy.

Connecting an institution is optional; you can enter balances and schedules by hand instead. We don’t control Plaid or your institutions and aren’t responsible for their availability or the accuracy of the data they provide.

Acceptable use

Don’t:

• access accounts or data that aren’t yours, or share your account with others;
• probe, scan or test the service’s security, or interfere with its operation (for example by scraping, automated bulk requests or overloading it);
• reverse engineer the service, except where the law allows it;
• use Geldfish for anything unlawful or fraudulent.

Your data

You own the financial information you provide. You give us a limited license to store and process it only to run Geldfish for you, as described in the Privacy Policy. We don’t sell your data. If you send us feedback or suggestions, we may use them without obligation to you.

Fees

Geldfish is free during the beta. If we introduce paid plans, we’ll tell you the price and terms before you’re charged anything, and you can choose not to subscribe.

Ending your account

You can delete your account at any time in Settings → Profile; that deletes your data as described in the Privacy Policy. We may suspend or close accounts that break these terms, put the service or other users at risk, or where the law requires it. We may also change or stop parts of the service, and will try to give reasonable notice of significant changes.

Disclaimers

Geldfish is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t warrant that the service will be uninterrupted, error-free or that projections will be accurate.

Limitation of liability

To the fullest extent the law allows, Otterlytics LLC and its members, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or decisions you make based on Geldfish, even if advised of the possibility. Our total liability for any claim relating to Geldfish is limited to the greater of the amount you paid us in the 12 months before the claim or US $100.

Some jurisdictions don’t allow some of these limits, so they may not all apply to you.

Indemnity

You agree to defend and indemnify Otterlytics LLC against claims, losses and costs (including reasonable legal fees) arising from your misuse of Geldfish or your violation of these terms or of someone else’s rights.

Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute relating to these terms or Geldfish will be brought in the state or federal courts located in Texas, and you and we consent to their jurisdiction. Before filing a claim, please email us so we can try to resolve it informally.

Changes to these terms

We may update these terms. If a change is material, we’ll update the date above and ask you to review and accept the new terms before you continue using Geldfish.

Everything else

These terms and the Privacy Policy are the whole agreement between you and us about Geldfish. If a provision is found unenforceable, the rest stays in effect. Not enforcing a provision isn’t a waiver. You may not transfer these terms; we may transfer them as part of a merger, acquisition or sale of assets. You agree that we can send you notices electronically, by email or in the app.
